1.  The police officer took my CDL license when I was arrested for a DUI, can I still drive?    (back to top)     

     An operator of a commercial motor vehicle must always have in his possession a valid commercial drivers’ license.  If you were arrested for a DUI and were issued a DPS 1205, you cannot operate a commercial vehicle.  This applies regardless of whether you were driving a commercial vehicle or non-commercial vehicle at the time of your arrest.  


2.  Can I get a limited permit for a CDL License? (back to top)

     No, a limited permit is not available for operating a commercial vehicle.  You may drive a non-commercial vehicle on a 30-day or 120-day limited permit, but not a commercial vehicle.

 

3.  What will happen if I received a DUI while operating a commercial vehicle?  (back to top)

     If you are convicted of a DUI with a .04% or more alcohol content, you will be subject to a 1-year disqualification from operating a commercial motor vehicle.  
 


4.  What if I refused to submit to Chemical testing of my blood, breath, or urine after my arrest? (back to top)
   
     You will be subject to a 1-year disqualification of the CDL license; however, a Class C license may be obtained after 120 days provided you complete “DUI School” and pay the reinstatement fee.    
  
    
5.  When can I have my CDL reinstated?

     If a CDL holder is convicted of a DUI (first lifetime) while operating a non-commercial vehicle, he may reinstate the commercial driver’s license after 120 days. 

     If the CDL holder is convicted of a DUI (first lifetime) while operating a commercial vehicle he or she may not reinstate the CDL until 1-year following the conviction.  
 

  
6.  If I am convicted of a 2nd DUI, can I still have my CDL reinstated?  (back to top)   

     No.  If you are convicted of a second DUI (lifetime), no matter what kind of motor vehicle you were driving at the time of the DUI arrest, you are disqualified from operating a commercial motor vehicle for life.  

     The DMVS does issue regulations that may allow a lifetime disqualification to be reduced to a period of not less than 10 years.  The applicant will be required to submit proof of rehabilitation, which must be approved by the DMVS.
